Our Commitment to Your Privacy

Monifly Financial Services Ltd. (“Monifly,” “we,” or “us”) is committed to the privacy of your personal information in accordance with the Canadian privacy laws, including:

  • The Personal Information Protection and Electronic Documents Act (PIPEDA)
  • Provincial legislation such as Quebec’s Law 25, Alberta’s PIPA, and British Columbia’s PIPA

We implement technical and organizational measures to protect your information and establish trust with employees, customers, and partners.

Information We Handle

We handle personal data for the purpose of providing financial products, including:

  • Identity & Contact Details: Name, address, email address, telephone number
  • Financial Details: Account numbers, transaction history, payment terms
  • Technical Details: IP address, device type, cookies (see Section 8)
  • Verification Details: Official government-issued identification, authentication records

Please note that your business contact details (e.g., job title, work email) can also be treated as personal information under Canadian law.

Purpose of Collection

We collect personal information in order to:

  • Process and fulfil your orders
  • Offer customer service
  • Improve our services and products
  • Comply with legal requirements in Canada
  • Send marketing messages with consent
  • Comply with financial and anti-money laundering requirements

Consent

We obtain adequate consent before collecting personal information. Consent may be express or implied depending on the sensitivity of the information and the reasonable expectations of the individual. We shall obtain express consent for sensitive data (such as identity and financial data) except where legally permitted.

International Data Transfers

Monifly may transfer your personal information to recipients beyond the country where it is initially gathered, including but not restricted to Canada, the EU, and the UK. Transfers are done in accordance with applicable legislation and can be subject to legal obligation or regulatory necessity.

Should personal information be transferred beyond Canada, we ensure equivalent levels of protection through:

  • Standard Contractual Clauses or corresponding measures
  • Third-party processor due diligence
  • Quebec’s Law 25 cross-border transfer evaluation

Your information may be disclosed to:

  • Service Providers: Payment processors, banking partners (e.g., Canada/USA/EU/UK)
  • Agents & Business Partners: Arranging requested services
  • Regulatory Authorities: As required by law
  • Risk & Verification Partners: Anti-fraud protection, identity verification
  • In the event of a business transfer (e.g., merger or acquisition)

Your Rights Under Canadian Privacy Laws

You have the right to:

  • Receive access to your personal information
  • Ask for correction of inaccurate or incomplete information
  • Withdrawal of consent (where processing is based on consent)
  • Request information about use and disclosure of your data
  • Complain to the Office of the Privacy Commissioner of Canada

Automated Decision-Making (Where Applicable)

If automated means are used to make decisions having a direct, significant effect on you (e.g., credit rating or anti-fraud), you are entitled to:

  • Request for human intervention
  • Challenge of decision
  • Explanation of reasoning applied

Data Security

We apply physical, organizational, and technical controls proportionate to the sensitivity of the information, including:

  • Encryption protocols and secure servers
  • Employee training and role-based access
  • Regular vulnerability scanning and auditing

We hold personal data for as short a time as necessary to fulfil the objectives it was initially collected for, or as governed by Canadian law. For example, accounts of financial transactions can be held for a maximum of 7 years for regulatory purposes. Data that is no longer required is deleted securely.
